The Williamsburg Police Department is a smaller municipal force. The city itself has a compact footprint, but the department handles the same types of records as any Virginia police agency. Incident reports document crimes and other events. Crash reports cover traffic accidents within city limits. Arrest records show who has been taken into custody and on what charges. All of these fall under the Virginia Freedom of Information Act.

If you need records from the surrounding area, that falls under a different agency. James City County has its own police department at 4600 Opportunity Way, Williamsburg, VA 23188, with a phone number of (757) 253-1800. The James City County Sheriff's Office is at 5201 Monticello Ave, Williamsburg, VA 23188. Make sure you know which agency handled the incident before you file your request.

Williamsburg Police Records and FOIA

The Virginia Freedom of Information Act gives you the right to request police records from Williamsburg. Under Virginia Code Section 2.2-3700 et seq., all public records are presumed open. You do not need to explain why you want the records. Your request does not have to be in writing, but it helps to put it in writing so there is a clear record of what you asked for.

The city must respond within five working days of receiving your request. Day one is the day after the request arrives. Weekends and holidays do not count. If the department cannot respond in five days, they must give written notice explaining why, and they get up to seven more working days. That means a total of 12 working days at most.

Certain police records are exempt from release. Criminal investigation files fall under Virginia Code Section 2.2-3706, which makes disclosure of some information discretionary. Witness and victim identities can be withheld. Personnel records and documents covered by attorney-client privilege are also exempt. If your request is denied in whole or in part, the city must cite the specific code section and give you a reason.

Note: FOIA requests for police records from James City County go through a separate process. The county has its own FOIA portal and FOIA Officer. Do not send county requests to the Williamsburg Police Department.

For police records related to jail custody, inmate information, or civil papers served by the sheriff, contact the sheriff's office directly.

Police records from the sheriff's office are different from those held by the Williamsburg Police Department. The police department handles crime reports and arrests within city limits. The sheriff's office deals with corrections, court security, and civil matters. If you are not sure which agency has the records you need, start with the police department for crime-related requests and the sheriff for jail or court-related items.
