The Amherst Police Department also handles records requests. Generally, the Chief of Police is the point of contact. The department will provide a request form for you to fill out. An initial response must come within five working days after the request is received. Both the Sheriff's Office and the police department follow the same state FOIA rules.
Amherst County Police Records Request Process
Virginia's Freedom of Information Act (FOIA), Virginia Code Sections 2.2-3700 et seq., guarantees access to public records held by public bodies, officials, and employees. A public record is any writing or recording, regardless of format, that is prepared, owned, or in the possession of a public body in the course of public business. The law says FOIA should be interpreted liberally, in favor of access. Exemptions that allow records to be withheld must be read narrowly.
Amherst County must respond within five business days of receiving your request. "Day one" is the day after the request comes in. If it is not practically possible to respond in five days, the county can take seven more working days, for a total of 12. For criminal investigative files requested under Section 2.2-3706.1, an extra 60 working days are allowed, bringing the total to 65 days.
Fees may apply. The county charges for the actual costs of responding to FOIA requests. This includes staff time spent searching, copying costs, and any other direct costs. If the estimated cost goes over $200, a deposit may be required. If you owe money from a previous FOIA request unpaid for more than 30 days, the county may require payment before processing new requests.

The Amherst County Circuit Court handles felony cases, civil cases over $25,000, and family law matters. The Circuit Court Clerk maintains all court records, including criminal case files. For misdemeanor and traffic cases, the General District Court is the relevant court.

Statewide Criminal History for Amherst County
For a criminal history that covers all of Virginia, submit Form SP-167 to the Virginia State Police. The form must be notarized. The fee is $15. Mail it to Virginia State Police, Civil and Applicant Records Exchange (CARE), 7700 Midlothian Turnpike, North Chesterfield, VA 23235. Processing takes about 15 business days.
The SP-167 is a name-based search that returns arrest and conviction records from across the state. It will include any Amherst County arrests along with records from other jurisdictions.
